Get2Cop Virtual Event T&Cs Of Participation
These are the terms and conditions (the “Agreement”) governing your participation in the GET2COP event (the “Virtual Event”). By registering for the Virtual Event you agree to these terms, which form a binding legal contract between the Virtual Event owner and host, GET2COP CIC (“G2C” or “Owner and Organiser”) whose registered number is 14322490] whose registered address is Newport House, Newport Road, Stafford, Staffordshire, England ST16 1DA and the registered participant (“you” or “Participant”). If you are registering on behalf of another individual, it is your responsibility to ensure the person participating is aware of these terms and accepts them. By completing the registration on behalf of another individual you are warranting that you have made the Participant aware of these terms and that they have accepted these terms.
Under this Agreement, we are providing you with the GET2COP Application (“GET2COP”) with all the content, material or services available within GET2COP and all updates and upgrades to GET2COP (unless we ask for a separate agreement to be entered into for such updated and upgrades) and all associated documentation (“Documentation”).
This Agreement is not for the sale of GET2COP but to grant you a limited licence which allows you to use GET2COP and the Documentation under the terms of this Agreement. This means that you do not own GET2COP and are only allowed to use GET2COP in accordance with this Agreement. We remain the sole and beneficial owners or licensors of GET2COP and the Documentation at all times.
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY CLICKING ON THE ‘ACCEPT’ BUTTON, THESE TERMS WILL BECOME LEGALLY BINDING ON YOU. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, CLICK ON THE ‘REJECT’ BUTTON BELOW. THIS WILL MEAN THAT YOU ARE NOT ALLOWED TO USE GET2COP.
1.1 Access.
You must be at least [13] years old to use GET2COP.
Download of the free GET2COP app and completion of the registration process entitles you to access to the Virtual Event for which you have registered. Any and all costs associated with your attendance shall be borne solely by you, and G2C shall have no liability for such costs.
1.2 Use of Likeness.
By participating in the Virtual Event you acknowledge and agree to grant G2C the right to record, film, live stream, photograph, or capture your likeness [individually or ] as part of a group or crowd, in any media now available or hereafter developed and to distribute, broadcast, use, or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant to G2C includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or disseminate the media.
1.3 Virtual Event Content.
You acknowledge and agree that G2C, in its sole discretion, reserves the right to change any and all aspects of the Virtual Event, including but not limited to, the Virtual Event name, themes, content, program, speakers, performers, hosts, moderators, venue, and time. In the event the Virtual Event content is recorded by G2C it will be accessible to Participants.
1.4 Participants Risk.
Your access to the Virtual Event and use of the app is entirely at your own risk and you voluntarily and knowingly assume all such risk. G2C recommends that you back up all data, files, and applications on your device prior to installing the app. In no event shall G2C or the Virtual Event supporters and sponsors be responsible for any damage arising out of the use or inability to use the app, even if G2C or the G2C parties have been advised of the possibility of such damages. You are advised to safeguard important data and to use caution and not rely in any way on the correct functioning or performance of GET2COP.
- Licence
2.1 The Licence
We license you to install and use GET2COP provided you follow all the rules set out in this Agreement. :
- is only for you personally or as a group of individuals ( for example, a workplace teams or a group of friends) and not for business use for commercial gain;
- is granted to you until the end of the Virtual Event;
- is non-exclusive and non-transferrable; and
- starts from the moment you indicate your agreement to be bound by this Agreement by clicking ‘ACCEPT’.
2.2 Intellectual Property Rights
GET2COP and the Documentation and all the intellectual property rights in GET2COP or the Documentation, wherever arising, are owned by us or our licensors. You do not own any rights in GET2COP or the Documentation.
2.3 Copies
You are not permitted to make any copies of either GET2COP or the Documentation.
2.4 Restrictions on Licence
You may only use the Documentation to the extent necessary to enable use of GET2COP in accordance with the terms of this Agreement.
You are not allowed to:
- copy or modify the code to GET2COP in any way, including inserting new code, either directly or through the use of another piece of software;
- deliberately attempt to avoid, manipulate or interfere with any security features included in GET2COP; or
- pretend that GET2COP is your own or make it available for others to download or use in any form (including by way of copying the code of GET2COP and creating an independent version).
- Prohibited Conduct
3.1 Limitations on Use.
By registering for the G2C Virtual Event you agree not to sell, trade, transfer or share your access link and/or code, unless such transfer is granted by G2C. By registering for the Virtual Event, you agree not to sell or trade your access. If G2C determines that you have violated this policy, G2C may cancel your access, report you to law enforcement authorities, and ban you from the Virtual Event and any future Virtual Events.
3.2 Disruptive Conduct.
You acknowledge and agree that G2C reserves the right to remove you from the Virtual Event if G2C, in its sole discretion, determines that your participation or behaviour create a disruption , is offensive, defamatory or brings the name of G2C, GET2COP or any of their partners into disrepute, breaches any applicable laws or hinders the Virtual Event or the enjoyment of the Virtual Event content by other attendees or violates our [Acceptable Use Policy].
3.3 Recording, Live Streaming, and Videotaping.
Participants may only record and/or broadcast audio or video of the G2C Virtual Events for personal use and for broadcast on social media platforms and are responsible for complying with the terms of use of such platforms.
3.4 Unethical/Non-Compliant Business Practices.
G2C reserves the right to deny participation to anyone who engages in or is reputed to engage in unethical or non-compliant business practices. You must not use GET2COP to do any of the following things:
- break any applicable laws or encourage any unlawful activity;
- send, transmit or upload anything that is (or might be considered to be) defamatory, offensive, inflammatory, obscene or discriminatory;
- infringe our or anyone else’s intellectual property rights;
- transmit any harmful software code such as viruses;
- try to gain unauthorised access to computers, data, systems, accounts or networks;
- deliberately disrupt the operation of anyone’s website, app, software, server or business; or
- violate our [Acceptable Use Policy] in any other way.
3.5 In addition to the requirements and prohibitions set forth in this Section 2, G2C may also exclude any prospective participant from registering for or participating in the Virtual Event, in G2C’s sole discretion.
- Fees and Registration
4.1 Payment.
Participation in the Virtual Event is free.
- Donations
Participants are free to raise personal sponsorship and/or submit donations directly via the app. All participants are responsible for all fundraising activities and for complying with all applicable laws in relation to any fundraising activities and G2C does not take any responsibility in relation to such activities. Where applicable, all donations are paid directly by participants to the Talent Fund a UK registered charity no. 1185346 and will be administered by a Climate Panel to support charities and NGO’s working in the field of climate change and climate action and at no point does G2C receive or administer any such donations. You may be asked to pay fees directly to third parties when making a purchase or donation through a third party.
- Cancellation and Quality Assurance
6.1 G2C strives to provide you with the most productive and effective experience possible. If after attending the Virtual Event you feel there is some way we can improve, please provide us in writing with your comments.
6.2 If G2C is prevented from carrying out its obligations as it pertains to the Virtual Event as a result of any cause beyond its control, or the Virtual Event cannot be Virtually conducted because of a software or issue with the hosting platform or due to acts of God, strikes, labour disputes, government requisitions, restrictions or war or apparent act of war, terrorism, disaster, civil disorder, epidemic or pandemic, curtailment or restriction on transportation facilities, or any other comparable calamity, casualty or condition (collectively a “Force Majeure”) G2C shall have the right to immediately terminate the affected Virtual Event without liability and shall be relieved of its obligations to you. If the affected Virtual Event is terminated due to a Force Majeure occurrence before the first day of the Virtual Event, then G2C may reschedule the affected Virtual Event.
6.3 We can immediately end this Agreement at any time for any or no reason at any time. Without prejudice to the foregoing, where possible and where we consider it appropriate, we will try to give you reasonable notice before termination.
- Virtual Event Registration Confirmation
7.1 Once you have completed your registration, you will receive an OTP confirmation by email. Please ensure that your email address is valid and is entered correctly on the registration form. Be sure to check your junk email box too in case any of the Virtual Event email(s) are caught by spam filters.
7.2 You will receive essential information for registered attendees electronically by push notification via the app.
7.3 In addition, you will also be added to a Virtual Event participant list for the purpose of creating a petition demanding action to stop climate change from policymakers. The Virtual Event participant list will become a social network for climate change following the Virtual Event.
7.4 In addition you will be asked to make a pledge to reduce your carbon emissions to a minimum. This is not compulsory.
- Your Privacy Is Important to Us
GET2COP is a data controller in respect of the personal data we collect from you and we will comply with Data Protection Legislation in the collection, processing and storage of your personal data.Our full privacy policy is published [here ] for your information. This explains what personal information we collect from you, how and why we collect, store and use and share such information, your rights in relation to it and how to contact us and supervisory authorities if you have a query or complaint. Note that some personal information is collected automatically by GET2COP, whereas other personal information is collected by us at your or our request. In relation to some personal data, we must ask for your consent to collect and process it, and if you do not give that consent, you may not be able to use al the functionality of GET2COP fully, because the full participation and use of GET2COP depends on the uploading of your personal data.
Please read the information set out in our privacy policy carefully as it is important.
- External Services
9.1 GET2COP may enable you to access services and websites that we do not own or operate (referred to below as ‘external services’).
9.2 We are not responsible for examining or evaluating the content or accuracy of these external services. Before using them, make sure you have read and agreed to the terms on which they are being offered to you including the way in which they may use your personal information.
9.3 You must not use external services in any way that:
- is inconsistent with this Agreement of the terms of the external service; or
- infringes our intellectual property rights, or the intellectual property rights of any third party.
9.4 From time to time, we may change or remove the external services that are made available through GET2COP.
9.5 GET2COP relies on a number of things working properly to enable you to enjoy all of its features. Many of these, such as your internet connection and your device, are entirely outside of our control. Although we will do everything we reasonably can to resolve issues, we are not responsible to you if you are unable to use all or any part of GET2COP due to a poor internet connection, faulty components in your device (such as faulty accelerometer) or anything else that it would not be reasonable to expect us to control.
- Changes to this Agreement
10.1 We may need to revise this Agreement from time to time to reflect changes in GET2COP’s functionality, to deal with a security threat or if there is a change in the law or guidance or where we consider it to be necessary.
10.2 You will be asked to agree to any material changes in advance, usually when you download an update. If you do not accept the changes, you will not be able to use GET2COP.
- Our responsibility to You
11.1 If we breach this Agreement or are negligent, we are liable to you for foreseeable loss or damage that you suffer as a result. By ‘foreseeable’ we mean that, at the time you clicked to accept this Agreement, either it was clear that such loss or damage would occur of you and we both knew that it might reasonably occur, as a result of something we did (or failed to do).
11.2 We are not liable to you for any loss or damage that was not foreseeable, any loss or damage not caused by our breach or negligence, or any business loss or damage, for example, loss of business opportunity, business interruption, or loss of profits.
11.3 GET2COP is provided in substantially the same form to all our users. It is your responsibility to make sure you have read the conditions for its permitted uses and specifications as these may not match the specifications of your device or your intended use.
11.4 Nothing in these terms excludes or limits our liability for any death or personal injury caused by our, or any of our employees’, agents’ or subcontractors’ negligence, liability for fraud or fraudulent misrepresentation, or any other liability that the law does not allow us to exclude or limit.
- Third Parties
No one other than us or you, or the person on whose behalf you registered, has any right to enforce any term of this Agreement.
- Transferring this Agreement
We may transfer our rights under this Agreement to another business without your consent. You are not allowed to transfer your rights under this Agreement to anyone without our prior written consent.
- Governing Law and Jurisdiction
14.1 English law applies to this Agreement, although if you are a resident elsewhere you will retain the benefit of any mandatory protections given to you by the laws of that country.
14.2 Any disputes will be subject to the non-exclusive jurisdiction of the English courts.
I CONFIRM THAT I HAVE READ AND UNDERSTOOD THESE TERMS AND CONDITIONS.
Are there any minimum technical specifications? E.g. the latest update to the operating system? Should the user be required to download any updates of the app?
Minimum is iOS version 13.
Latest version is 15.6
Minimum Android OS version is Android 5.0.
Latest version is 12.0
The apps are developed keeping a minimum OS version in mind.
